Use of the website.

01   What this is.

These Terms govern your use of higherpowerfoundation.org and any sub-domain operated by Higher Power Foundation (“HPF”, “the Foundation”, “we”, “us”, “our”), a Foundation operating from 119, Karimkuttical · 6A Cross · Bensathya Enclave · Kalyan Nagar · Bengaluru — 560043, India.

 

By using the site you accept these Terms. If you do not accept them, please do not use the site.

 

02   What the site is — and what it is not.


The site is informational. It exists to:

  • Describe the Foundation's residential and outpatient programmes.

  • Carry the Foundation's editorial work in The Register.

  • Provide a route to admissions enquiries.

  • Publish the Foundation's legal, accessibility, and privacy commitments.


The site is not:

  • A clinical service. Reading the site is not treatment. Use of the site does not establish a clinician–patient relationship.

  • A substitute for medical or psychiatric advice. Diagnosis, treatment, and medication decisions can only be made by qualified clinicians, in person, with the patient present.

  • An emergency service. For an acute medical or psychiatric emergency, contact your nearest hospital or call 108.

  • A booking platform. Admission is a clinical decision taken at intake under the Mental Healthcare Act, 2017 — not an online checkout.

 

03   Admissions enquiries.

Submitting an enquiry through the site does not guarantee admission. Admission to either programme follows a clinical conversation, an intake assessment, and a seven-day probationary period, as described under Admissions on the site.


04   Intellectual property.

The Foundation owns or licenses every element on this site, including:

  • The Higher Power Foundation name and the horizontal lockup [registration status: registered].

  • The B.A.R.E. Recovery Curriculum, its four-pillar architecture, the eight tools, the five-block session structure, and all workbook content.

  • The editorial work in ‘The Reading Room’.

  • All photography of the Foundation's spaces and objects.

You may read the site for personal, non-commercial use. You may not republish, reproduce, mirror, scrape, train AI systems on, or commercially exploit the content without the Foundation's prior written permission.

 

05   Acceptable use.

You agree not to:

  • Impersonate the Foundation, its staff, or its patients.

  • Submit false or misleading information through any form on the site.

  • Use automated tools to crawl or harvest data from the site beyond what the robots.txt file permits.

  • Attempt to gain unauthorised access to the site, its hosting infrastructure, or any backend system.

  • Use the site to send unsolicited communication of any kind.

 

06   Third-party links.

The site links to external resources, including the text of the Mental Healthcare Act, 2017 on legislative.gov.in, the DPDP Act on prsindia.org, and Alcoholics Anonymous (India). We provide these links for reference. We do not endorse, control, or assume responsibility for third-party content.

 

07   WhatsApp Business.

The Foundation uses WhatsApp Business to dispatch the Saturday family update to the approved family contact. Use of WhatsApp is subject to WhatsApp's own terms and privacy policy. If you do not wish to receive updates by WhatsApp, an alternative channel will be arranged on request — see the Privacy Policy.

 

08   Limitation of liability.

To the extent permitted by Indian law, the Foundation is not liable for:

  • Indirect, incidental, or consequential losses arising from use of the site.

  • Decisions taken on the basis of information on the site that should have been verified with a clinician.

  • Interruption to the site caused by hosting, network, or force majeure events.

Nothing in these Terms limits any liability that cannot lawfully be excluded — including liability under the Consumer Protection Act, 2019, and any rights you may have under applicable medical-services legislation.

 

09   Data and privacy.

Use of the site is also governed by the Privacy Policy, which is incorporated into these Terms by reference.

 

10   Governing law and jurisdiction.

These Terms are governed by the laws of India. The courts at Bengaluru, Karnataka, have exclusive jurisdiction over any dispute arising from these Terms or from use of the site.

 

11   Changes to these Terms.

We may amend these Terms from time to time. Material changes are notified by a banner on the home page for thirty days following the change. The current edition number is stated in the website footer.
